Terms of Service for Astro-COLIBRI

Welcome to Astro-COLIBRI! These Terms of Service ("Terms") govern your access to and use of the Astro-COLIBRI Service ("Service"), including our website, mobile application, application programming interface ("API"), and Kafka event-stream broker ("Broker"), provided by the Astro-COLIBRI project ("Astro-COLIBRI," "we," "us," or "our"). Fabian Schüssler represents Astro-COLIBRI for these Terms and commercial-licensing requests. By accessing or using the Service, you agree to comply with these Terms. If you do not agree, you may not use the Service.
1. License and Acceptable Use
1.1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial purposes, including personal, educational, public-research, charitable, and governmental use, in accordance with these Terms.
1.2. Commercial Authorization
Commercial use of the Service, its data, or separately distributed Astro-COLIBRI software requires prior express written authorization from Astro-COLIBRI. Any authorization applies only to the software, Service component, data, organization, and use case explicitly identified in that authorization. Requests may be sent to astro.colibri@gmail.com.
1.3. Separately Distributed Software
Astro-COLIBRI client libraries, software development kits, parsers, and other software are governed by the license included with each distribution. A software license does not grant access to the hosted Service or rights to Service data. These Terms do not replace or expand the license supplied with separately distributed software.
1.4. Prohibited Uses
You may not:
- Use the Service to develop paid or commercial services without prior written approval from us.
- Redistribute, resell, or otherwise exploit data or services obtained via the Service for financial gain.
- Access the Service in a manner that could disrupt or damage our services or infrastructure.
- Use the Service for any illegal, harmful, or fraudulent activities.
- Attempt to bypass or manipulate the subscription system or receipt validation.
2. API and Event Broker Access and Security
If you use our API or Broker, the following additional terms apply:
2.1. Personal Access Credentials
API keys and Broker usernames and passwords are personal to your account, confidential, and non-transferable. You are responsible for activities performed with your credentials. You may not share them with another person or organization. If credentials may have been exposed, you must promptly rotate or revoke them through your account or contact Astro-COLIBRI.
2.2. Broker Access
The Broker provides read-only event streams. You may consume only the topics and consumer groups authorized for your account. You may not publish data, alter or administer the Broker, bypass authentication or access-control rules, use a consumer-group prefix not assigned to you, access unauthorized topics, or interfere with other users.
2.3. Usage Limits and Availability
We may limit API requests, Broker connections, consumption rates, topic access, consumer groups, and data retention to protect the Service and ensure fair use. We do not guarantee uninterrupted availability, delivery, completeness, timeliness, or any particular retention period for API or Broker data. Exceeding limits or interfering with the Service may result in suspension or termination of access.
2.4. Monitoring
We may monitor API and Broker usage, authentication attempts, and related operational logs to secure the Service, troubleshoot failures, and enforce these Terms. Misuse may result in suspension or permanent revocation of access.
3. Subscriptions and Payments
3.1. Billing
Payments for the Astro-COLIBRI AR mode subscription can be made through the following channels:
- Apple App Store — purchases made on iOS or macOS are subject to Apple's terms and conditions.
- Google Play Store — purchases made on Android are subject to Google's terms and conditions.
- Web (RevenueCat Billing / Stripe) — subscriptions purchased directly through our web interface are processed by RevenueCat using Stripe as the payment processor and are subject to RevenueCat's and Stripe's respective terms. We do not store payment card details.
The subscription price is identical across all platforms.
3.2. Auto-Renewal
Subscriptions automatically renew unless canceled before the end of the current billing period. For App Store and Google Play subscriptions, cancellation must occur at least 24 hours before the period ends. Web subscriptions can be canceled at any time through the subscription management section of your Astro-COLIBRI account.
3.3. Refunds
Refund eligibility and handling depend on the platform through which the subscription was purchased:
- App Store purchases: contact Apple Support or request a refund via reportaproblem.apple.com.
- Google Play purchases: contact Google Play Support or request a refund through the Play Store.
- Web purchases: contact us at astro.colibri@gmail.com. Refund requests will be assessed and processed through RevenueCat/Stripe where applicable.
4. Data Usage and Ownership
4.1. Ownership
Data, content, and intellectual property accessed via the Service remain the property of Astro-COLIBRI or their respective data providers and licensors. Additional notices or terms supplied by a data provider continue to apply. These Terms do not transfer ownership of any content, data, or intellectual property rights to you.
4.2. Permitted Use of Data
You may use data retrieved via the Service solely for non-commercial purposes, including personal, educational, public-research, charitable, and governmental use, unless expressly permitted otherwise.
4.3. Restrictions
You may not:
- Modify or obscure data to misrepresent its source.
- Use the data to train machine learning models for commercial purposes.
5. Termination
We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including but not limited to violation of these Terms. Upon termination, you must immediately cease all use of the Service and delete any data retrieved via the Service.
6. Disclaimer of Warranties and Limitation of Liability
6.1. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Specifically, we do not warrant, guarantee, or assume any responsibility for the correctness, accuracy, completeness, reliability, or timeliness of any data, alerts, afterglow models, or other information provided through the Service, API, or Broker. We are not responsible and cannot be held accountable or liable for any errors, omissions, inaccuracies, or out-of-date information in our data, nor for any research decisions, observations, or other actions taken in reliance upon Service, API, or Broker data.
6.2. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
7. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
8. Modifications to Terms
We may update these Terms for legal, security, operational, or Service-related reasons. For material changes, we will provide reasonable advance notice through the Service or the contact information associated with your account where reasonably practicable, and we will identify the effective date of the revised Terms. If you do not agree to a change, you may stop using the affected Service and revoke Broker access or delete your account before the change takes effect. Continued use after the effective date constitutes acceptance except where applicable law requires explicit acceptance. The latest version will always be available on our website.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of France. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts located in Paris/France.
